In the Groove
O
ften, some of our most popular stories, both online and in this magazine,
discuss plan governance and compliance. For editors, that content can be
easy to find, as regulatory agencies are always humming, and legal suits
continue to be filed. It's our role to help make sense of these suits, especially as the
experts we talk to express varying views on them. Each story that results is a good
and instructive read. Our cover story this issue, " The Case for a Process " (page 14)
is an excellent resource for plan sponsors, explaining how they can lessen their
plan's exposure to such legal suits. Several ERISA attorneys make suggestions for
how a plan committee can utilize good governance as a good defense.
For the sixth year, PLANSPONSOR is pleased to honor plans by giving its Best
in Class 401(k) Plan designation. The 34 selected were from two groups of sponsors
this year. Most were chosen based on the sponsor's answers to our 2019 Defined
Contribution (DC) Survey. But the industry keeps evolving. So to make sure all
designees are Best in Class according to our current criteria, they need to requalify
every five years. We just reviewed our first designees. See who we honored in " In the
Groove " (page 20). If your plan resembles our honorees' plans and you'd like to be

The passage of the Setting Every Community Up for Retirement Enhancement
(SECURE) Act has eased the way for employers to offer lifetime income solutions, also
known as guaranteed income products or annuities, in their plan. Notable among the
act's provisions is the addition of a safe harbor clarification, reducing the sponsor's
potential liability in choosing a provider. " A Changed Perspective " (page 30) lays out
the options sponsors have available to-safely-help participants who worry they'll
outlive their income. And " Income Insight " (page 38) discusses the act provision that
participants must be given annual lifetime income projections.
Our PS Coach department covers plan fundamentals. In this issue (page 42), we
examine best practices for summary plan descriptions (SPDs). Sources stress that the
document should be in plain English. It was a nice surprise to see that there's a trend
toward creative presentation and easier to digest information so participants, if they
wish, can more enjoyably access what they need to know about their retirement plan.
